Michael J. Young is an elder law attorney who represents older clients.

This area of the law includes the preparation of traditional estate planning documents. However, the emphasis and language in these documents for the older client is different, and is geared toward ‘What happens if we don’t die’, as opposed to ‘What happens when we do die.’

Mr. Young also prepares long term care plans for older clients. These plans take into account the client’s assets, and how the client might be taken care of during various stages of his or her life with his available assets. For instance, how will in home care be paid for? How will assisted living facilities and possible nursing home costs be paid for?

Mr. Young helps his clients plan for and obtain the VA Aid and Attendance Improved Pension Benefit, which can help pay for in home care, board and care and assisted living facility costs. In addition, Mr. Young helps his clients plan for and obtain Medi-Cal benefits, which pay for nursing home costs. Nursing home costs can exceed $7500 per month in Contra Costa County.

Transfers and protection of assets is part of the planning for the older client. Any transfers for VA qualification must be done in coordination with Medi-Cal transfer regulations. If transfers and asset protection is not done properly, you could be qualified for the VA Aid and Attendance Pension Benefit, but disqualified for Medi-Cal benefits.
